2 - Pro-se (self representation) You must go to the Family Court Self Help in Downtown and buy a packet of forms for $65
3 - Download divorce forms from the internet
Here are the three options broken down with their pro's and con's and our alternative:
OPTION 1 - HIRE AN ATTORNEY
1 - Don't have to worry about the forms
2 - The attorney will handle communications with the ex and the court
3 - Legal advice throughout the process
1 - Expensive
2 - When you go in front of the judge you will be the one speaking, not the attorney
3 - Every time you call or email your attorney it will cost you money.
4 - Every letter, envelope they mail it will cost you money.
5 - Most of the times you will be communicating with the legal secretary.
6 - Even if you qualify for a court filing fee waiver (a potential savings of $409) you cannot apply due to using an attorney.
OPTION 2 - PRO-SE
1 - Affordable, the forms are only $65
1 - The length of the process. You first buy the forms, then call to make an appointment (they rarely pick up their phone). The appointment is typically 3 weeks AFTER calling.
2 - You either must know how to complete the forms or hire someone to complete them. There are only a few document preparers in Miami that knows the divorce process enough to complete the forms accurately. If anything is wrong get ready to come back a week later with the corrections.
3 - You have to pay for a notary to make the notarizations. If you made a mistake you have to pay again to a notary to fix the forms they deemed wrong.
4 - You must go to the appointment with your spouse if there are children. They don't tell you this but during your appointment they calculate child support for you and enter it in the MSA. Even if your ex already signed it he will need to sign it again with the child support amounts. This means making another appointment, taking off from work again, paying a notary again, etc.
5 - Most of the time the clerk of court in Miami does not accept the waiver for the filing fee even if you qualify. Why? We have no clue, but many of our clients have gotten rejected.
OPTION 3 - FORMS FROM THE INTERNET
1 - Don't have to pay the $65, only $15 to have them review the forms at the Self Help Program in Miami
1 - Can't file the forms directly with the clerk of courts. Have to call the Miami Family Court Self Help Program to make an appointment to have them reviewed and accepted.
2 - See the con's in option 2...they all apply
3 - The forms from the internet may not be up to date.
4 - The Self Help Program in Miami may not accept the forms, they may be the wrong ones, may be incomplete, etc. and you may have to start all over again.

1 - For our express divorce, the couple have to be in 100% mutual agreement. Even with the child support issues (which we will calculate based on the Florida child support law).
